General Information About Personal Data Protection Law

Law No. 6698 on the Protection of Personal Data (KVKK) was adopted on March 24, 2016 and published in the Official Gazette No. 29677 dated April 7, 2016. Some provisions entered into force on the publication date, while others entered into force on October 7, 2016.

Information as Data Controller

Pursuant to Law No. 6698 and in our capacity as data controller, your personal data may be recorded, stored, updated, disclosed or transferred to third parties where permitted by law, classified, and processed in the manners specified under KVKK within the framework explained on this page.

How Your Personal Data May Be Processed

Pursuant to Law No. 6698, personal data you share with our company may be processed by us by being obtained fully or partially through automated means, or through non-automated means provided that it forms part of a data recording system, and by being recorded, stored, changed, reorganized, or otherwise subjected to any operation performed on data.

Within the scope of KVKK, any operation performed on data is considered processing of personal data.

Third Parties to Whom Personal Data May Be Transferred

For the purposes stated above, personal data you share with our company may be transferred to persons and organizations related to the services provided, such as suppliers and cargo companies; partner organizations from which we receive services or cooperate as data processors to carry out our activities; domestic or foreign organizations; and other third parties.

Methods of Collecting Personal Data

Your personal data may be collected through the following channels and methods:

  1. Information such as name, surname, Turkish ID number, address, phone number, business or personal email address collected through forms on our website and mobile applications; preferences on pages accessed with username and password; IP records of transactions, cookie data, browsing duration and details, and location data.
  2. Data obtained verbally, in writing, or electronically through our sales and marketing employees, branches, suppliers, other sales channels, paper forms, business cards, digital marketing, and call center channels.
  3. Data received physically or virtually, face-to-face or remotely, verbally, in writing, or electronically from persons who share personal data through business cards, resumes, proposals, and similar means for purposes such as establishing a commercial relationship, applying for a job, or submitting an offer.
  4. Data obtained indirectly from different channels, including websites, blogs, microsites used for contests, surveys, games, campaigns, and similar purposes, social media data, e-newsletter reading or click actions, public databases, and publicly shared profiles and data on social media platforms.

Personal Data Obtained Before KVKK Entered Into Force

Personal data lawfully obtained before April 7, 2016, the effective date of KVKK, through membership, electronic communication consent, product or service purchase, and other means is processed and retained in accordance with the terms and conditions set out in this document.

Transfer of Personal Data Abroad

Personal data collected through any of the methods listed above may be transferred to service intermediaries located abroad, provided that it remains within the scope of KVKK and is consistent with contractual purposes, whether processed in Turkey or processed and stored outside Turkey.

Such transfer may be made to countries accredited by the Personal Data Protection Board and deemed to provide adequate protection for personal data.

Storage and Protection of Personal Data

Your personal data will be kept confidential in the databases and systems of our company pursuant to Article 12 of KVKK and will not be shared with third parties except for legal obligations and the provisions stated in this document.

Our company is obliged under Article 12 of KVKK to protect systems and databases containing personal data through software measures, access management measures, and physical security measures that prevent unlawful processing and unauthorized access.

If it is discovered that personal data has been obtained by others through unlawful means, the situation will be immediately reported in writing to the Personal Data Protection Board in accordance with the law.

Keeping Personal Data Accurate and Up to Date

Pursuant to Article 4 of KVKK, our company is obliged to keep your personal data accurate and up to date. In this context, customers must share accurate and current data or update it through the website or mobile application so that our company can fulfill its legal obligations.

Rights of the Data Subject Under Law No. 6698

Article 11 of Law No. 6698 entered into force on October 7, 2016. Pursuant to this article, the rights of the data subject after this date are as follows:

  1. To learn whether personal data is processed.
  2. To request information if personal data has been processed.
  3. To learn the purpose of processing personal data and whether it is used in accordance with that purpose.
  4. To know the third parties to whom personal data is transferred domestically or abroad.
  5. To request correction if personal data has been processed incompletely or inaccurately.
  6. To request deletion or destruction of personal data under the conditions set forth in Article 7 of KVKK.
  7. To request notification of correction, deletion, or destruction operations to third parties to whom personal data has been transferred.
  8. To object to the occurrence of a result against the person through analysis of processed data exclusively by automated systems.
  9. To request compensation for damages if harmed due to unlawful processing of personal data.

AYKA OPTIK Gida Koz. Tem. Paz. San. Ve Tic. Ltd. Sti., registered with Ankara Chamber of Commerce and Industry under registration number 114567, with MERSIS number 0 1230 0590 5000016, located at Sakarya Cad. No1/23 Kizilay / Ankara, is the data controller under KVKK.

The Data Controller Representative to be appointed by our company will be announced in the Data Controllers Registry and on the web address where this document is published once the legal infrastructure is available.
